The root of opposition to the Akaka Bill is that it would (through it’s suppositions or claims of fact) legitimize the 1893 unlawful overthrow of the Hawaiian Kingdom and extinguish any further native Hawaiian claims for redress or sovereignty. Giving ancestral Hawaiians the same status as that of tribal American Indians, not of citizens under a constitutional government, the former established Kingdom of Hawaii. The bill has been floating around in different forms for the last 10 years and was reintroduced this year as well. It’s back in the spotlight again due in part to the U.S. Supreme Court case, Hawaii vs. Office of Hawaiian Affairs, which was ruled on last month.
